Massachusetts Septic & Well Water Rules

Massachusetts septic systems are regulated under Title 5 of the State Environmental Code (310 CMR 15.000), administered by MassDEP and local boards of health.

Inspection when you sell

For most property transfers, Title 5 (310 CMR 15.301) requires a septic system inspection at or within two years before the title transfer, and the buyer must receive the full inspection report.
If weather prevents the inspection, it may be done up to six months after transfer if the seller gives written notice.
Certain transfers are exempt, such as some transfers between spouses or between parents and children, refinancings, and some foreclosures. Check the MassDEP guidance for the full list.
